General Terms and Conditions

1. General
SUP 2 Go is a rental service for water sports equipment.

The use of the stand-up paddle boards (hereinafter referred to as "SUP") and accessories is at your own risk. Rentals are provided by SUP 2 Go (hereinafter referred to as "Lessor") exclusively to self-collectors (hereinafter referred to as "Lessee" or “Renter”) and only upon presentation of a valid identification document.

For underage persons, the rental agreement must be signed in person by a legal guardian. The legal guardian is liable for the minor for the duration of the rental or until the proper return of the SUP.

2. Duties of Care, Conduct Obligations, and Precautionary Measures of the Renter
By entering into the rental agreement, the renter confirms that they and all other users of the SUP board are swimmers without exception. If this is not the case, the lessor assumes no liability for any property or personal damages that occur during the rental period as a result.

Anyone venturing more than 300 meters from the shore on lakes must carry a life jacket in the correct size, or at the very least, a flotation device with a minimum buoyancy of 50 Newtons per person. This also applies to the navigation on rivers. In general, it is recommended to always wear a flotation device, regardless of the distance to the nearest shore. For children and adolescents under 18 years of age, wearing life jackets at all times is strongly recommended! Inflatable flotation devices are not a substitute for life jackets.

The renter agrees to carefully inspect all rented items for proper functionality and seaworthiness before commencing the journey. Any damages must be reported to the lessor immediately and the renter must refrain from the use until a common solution or agreement has been reached with the lessor. If air should escape from the SUP while on the water, the renter or user of the rental item must immediately exit the water using the shortest route. This also applies to changes in weather conditions (e.g., approaching thunderstorms, heavy rain, or strong winds).

Prohibitions on travel and private regulations in areas of non-public property must be observed and obeyed. Meadows, pastures, and fields along the shores are partially privately owned and must not be entered. Waste must be collected in garbage bags and disposed of in publicly placed trash cans or taken with you and disposed of in household waste. All areas must be left absolutely clean.

In the event of disregard for nature, misconduct, especially due to alcohol abuse, noise, material abuse, or ignoring the duties of care and conduct obligations, and improper waste disposal, the lessor cannot be held liable. All costs and consequences must be borne by the renter. The consumption of alcohol, tobacco products, and narcotics of any kind is prohibited while riding the SUP.

The renter must inform themselves of the rules, dangers, and regulations of the respective waters before using the SUP board. The lessor assumes no liability for violations or accidents of any kind, as they are beyond the lessor's control.

In the event of non-compliance with the duties of care, conduct obligations, and precautionary measures, the lessor is entitled to terminate the rental immediately. The rental price and any incurred costs will be retained in full in this case.

The renter must return the rental items completely and in person by the specified return date and time. The renter is obligated to handle the rental items with care. Losses of rental items, as well as damages and permanent stains caused by the renter (hereinafter collectively referred to as 'deficiencies'), will be rectified or removed at the renter's expense. The costs for repairs or replacement of lost rental items can be obtained from the following table.

3. Prices
The rental prices depend on the rental duration and the number of rented SUP sets and are based on the latest price list for Zurich, published on our website at https://sup-2go.com/zuerich.html.

4. Rental duration
The rental duration is agreed upon in advance and can be on an hourly, daily, or weekly basis. An extension of the contractually agreed rental period can be arranged at an additional cost, subject to availability.

5. Payment
The rental fee is to be paid no later than upon handover of the SUP set. Payments upon handover can be made in cash, via TWINT, or PayPal.

SUP 2Go reserves the right to request a deposit of 20% of the agreed rental fee, which will be deducted from the payment due upon handover. A refund of the deposit amount will only be issued in the event of a timely cancellation prior to the start of the rental period, at least 24 hours for single reservations or 48h for group reservations. If payment by invoice is agreed upon, it is due and payable immediately upon receipt of the invoice and prior to the rental. The same applies to the issuance of vouchers. The rental period is determined by the lessor.

6. Deposit
SUP 2Go reserves the right to request a deposit of CHF 50 per SUP board before or at the beginning of the contract. This will be refunded after the complete return of the rental items, minus the costs for late return or the rectification of deficiencies (loss or damage of rental items as well as stains) caused by the renter.

7. Handover
The handover takes place at one of our locations at the agreed pick-up date and time. Handover is only done upon presentation of a valid identification document and after settlement of the full invoice amount, as well as possibly depositing the rental deposit. Delivery of the SUP set by us can be arranged subject to an additional fee. In case of delay, the rental may be refused.

8. Return policy
The renter must return the rental items completely and in person by the contractually agreed return date. If nothing contrary has been agreed, the return shall take place at the same location where the handover occurred. Pickup of the SUP set by us can be arranged subject to an additional fee.
A late return may be invoiced if it occurs outside of our opening hours or if subsequent rentals cannot be carried out as a result.

9. Liability
The lessor shall not be liable for bodily or personal injury to the renter or involved SUP users, except in cases of intentional or grossly negligent conduct. The lessor shall only be liable for other damages to the renter in cases of intent and gross negligence. The lessor assumes no liability for lost or damaged valuables of the renter. The use of the SUP boards is at the renter's own risk, and the renter must inform themselves about laws, hazards, and regulations before use. Parents are liable for their children.

The renter indemnifies the lessor from all claims arising from the violation of laws, regulations, or other clauses in connection with the use of the rental items by themselves or a third party. The renter also indemnifies the lessor from third-party claims resulting from accidents.

Upon transfer of the rental item, the renter assumes liability for it and is liable to the lessor for damages or losses resulting from intentional or negligent behaviour. If the renter signs for multiple participants, he/she remains liable to the lessor in all respects. In particular, he/she is liable to the lessor according to legal provisions for the other participants. In case of loss and/or damage to the rental item, the renter and, if applicable, users are jointly and severally liable if the legal requirements are met.

If safety instructions, especially duty of care, behavioural obligations, and precautionary measures listed under Section 2 of the terms and conditions or instructions from the handover protocol, are disregarded or not followed, the lessor shall not be liable for bodily, personal, or property damage to the renter or other persons, or damage to the property of third parties or nature.

10. Cancellation by the Customer (Cancellation, Reversal, Revocation)
Cancellation or revocation of a reservation must be made in writing. A mutual deadline of 24 hours before the planned start of the rental period applies for single reservations. For group reservations a deadline of 48 hours applies. If the cancellation or revocation occurs within the granted deadline, the customer is entitled to a refund of any payments made. A free cancellation of the contract with SUP 2Go by the customer requires our written approval. If the cancellation occurs after the expiry of the 24-hour or 48-hour deadline, respectively, the customer is not entitled to a refund. However, as a gesture of goodwill, the customer may be offered a free rescheduling or the issuance of a voucher for the amount of the prepayment made.

11. Rights and obligations in the event of impending force majeure
The lessor is entitled to cancel the rentals in the event of a health-endangering situation due to weather conditions (storm, severe weather, thunderstorms, flooding, high water, extreme low water, or heavy fog, etc.). In this case, the renter is not entitled to a refund of any ancillary costs (e.g., travel or accommodation costs, etc.). However, the renter is entitled to a full refund of any payments made towards the rental price up to that point.

The renter is obligated to return the rented item within the agreed return time, even in the event of sudden changes in weather conditions. If this is not possible, the lessor must be informed immediately.

12. Recovery of the rented item
If unforeseen circumstances arise that make the timely return of the rented item impossible, the renter is obligated to promptly inform the lessor so that a simple and cost-effective solution can be arranged. If the lessor is compelled to retrieve the rented equipment, in whole or in part, to secure his interest or prevent potential damage or loss of materials, even if this was not part of the original agreement, the renter named in the rental contract bears the costs associated with these measures if they have caused the cost-triggering measures through culpable actions.

13. Marketing
By signing this contract, the renter agrees to receive promotional messages via E-Mail, WhatsApp, or other social media channels. The renter may unsubscribe from receiving advertising at any time.

14. Ineffectiveness
If one or more clauses of these terms and conditions are or become ineffective, this shall not affect the validity of the remaining provisions. The ineffective provision shall be replaced by an effective provision that comes closest to the economic and legal intention of the contracting parties.

15. Place of fulfilment
Swiss law applies. The place of jurisdiction and fulfilment is Glattpark (Opfikon), Canton of Zurich.
